CITY - Committee Approves Permanent Easement



07/27/2010 - RAPID CITY SD - The City Council's Public Works Committee on Tuesday gave initial approval to a request to establish a permanent easement on the east side of the proposed Main Street Plaza site.   Final consideration and approval will happen at Monday's next City Council meeting. 

The Old Sears Building, owned by developer Steve McCarthy, was granted a conditional 10-foot easement along the west side of the building by then-Mayor Ed McLaughlin and the city council back in 1995.   The easement made it legal for windows to be installed in the west wall, overlooking the city parking lot, and made sure that any structure built west of the building would be at least ten feet from that wall. 

Growth Management director Marcia Elkins told council members that with the establishment of the Main Street Plaza on the lot west of the Sears Building, the easement should be made into a permanent easement, so that the west side of the building could host multiple storefronts at some future time.   Elkins told council members that there was no cost to the city involved into making the easement into a permanent easement.
